What Is BABA?
The Build America, Buy America (BABA) provision was enacted as part of the Infrastructure Investment and Jobs Act (IIJA) in 2021. It requires that all iron, steel, manufactured products, and construction materials used in federally funded infrastructure projects be produced in the United States.
For water infrastructure specifically, this applies to projects receiving funding through programs such as the Drinking Water State Revolving Fund (DWSRF), the Clean Water State Revolving Fund (CWSRF), and direct IIJA grants for water system improvements.
Chlorine analyzers and monitoring instrumentation are classified as manufactured products under BABA. Non-compliant equipment can delay project funding approvals, require waiver applications, or disqualify a bid entirely.
